Eamon Kelly has successfully pursued antitrust claims against some of the world’s largest and best-known companies.
In 2022, Eamon and his colleagues were recognized with the American Antitrust Institute Outstanding Antitrust Litigation Achievement Award for their work against Apple representing a class of app developers. Eamon was also appointed as co-lead counsel for a class of developer plaintiffs, favorably settling their antitrust claims against Google.
Eamon is a first-chair trial lawyer. He represents plaintiffs and defendants in commercial matters ranging from patent and trade secret disputes to investor, partner, and customer-contract disputes, and insurance coverage and recovery cases. He excels in framing and resolving cases, charting a path from the complaint to resolution, whether through negotiated settlement or at trial.
Eamon began his career representing policyholders in insurance disputes at Jenner & Block LLP and has taught, lectured, and written on insurance coverage matters.
Eamon is an active civic and bar leader. He served for 10 years as elected Democratic committeeperson for Evanston, Illinois. In that role, he served on the judicial slating committees for the Democratic Party of Cook County. Previously, he served as chief of staff for the Illinois State Board of Education, special assistant to the deputy governor of Illinois, and vice-chair of Illinois State Treasurer Michael Frerichs’s transition team.
Representative Matters
Secured a settlement of $453 million for direct purchasers of the drug Glumetza. In re Glumetza Antitrust Litigation, 19-cv-6156 (N.D. Cal.). The case involved allegations that direct purchasers of the pharmaceutical product Glumetza overpaid for the drug as a result of a payoff to potential generic competitors. Appointed to plaintiffs’ executive committee and secured a $100 million settlement and going-forward rate relief for App developers in Cameron et al. v. Apple, Inc. The case alleged Apple was able to charge supracompetitive fees to app developers. (Resulted in American Antitrust Institute Outstanding Antitrust Litigation Achievement award in 2022). Cameron v. Secured a $90 million settlement for small app developers as co-lead counsel in the Google Play Developer Class Litigation. Pure Sweat Basketball v. Google, 3:20-cv-05792 (N.D. Cal.).
Secured a settlement of $485 million for direct purchasers in Meijer, Inc. v. Ranbaxy Inc., Case No. 15-cv-11828 (D. Mass.). The claim alleged Ranbaxy conspired to defraud U.S. regulatory authorities into giving the company certain regulatory exclusivities to produce generic versions of Novartis AG's blood pressure drug Diovan, Pfizer's acid reflux medication Nexium, and Genentech's antiviral drug Valcyte.
Secured a unanimous jury verdict on behalf of a commercial real estate developer after pursuing contractual and tortious interference claims for breach of an option contract.
Won an arbitration against a big four accounting firm for gross negligence in conducting M&A due diligence on behalf of a private equity client.
Obtained complete dismissal of a suit alleging defamation per se and conspiracy against political candidates and party members.
Successfully defended corporate and individual clients in a business licensing dispute asserting multiple breaches of license and lease agreements, tortious interference with contract, fraudulent transfer, common law fraud, and unjust enrichment. Obtained dismissal of multiple counts at pleading stage and case settled shortly thereafter.
