SPERLING KENNY NACHWALTER FEATURED IN THE DAILY BUSINESS REVIEW FOLLOWING $155 MILLION ANTITRUST VERDICT

June 11, 2026 - We are proud to announce that Sperling Kenny Nachwalter’s recent $155 million jury verdict against Takeda Pharmaceutical was featured by the Daily Business Review, which interviewed firm partners Jonathan Stratton and Anna T. Neill.

Following a five-week trial in federal court in Boston, the jury found that Takeda unlawfully delayed generic competition for its drug Amitiza, resulting in substantial overcharges to plaintiffs. The verdict will be trebled to $465 million, bringing the total damages award for all plaintiffs to more than $885 million as part of a multi-firm trial team.

The decision is particularly significant because it represents the first jury verdict against a pharmaceutical company in a reverse-payment antitrust case since the U.S. Supreme Court's 2013 decision confirming that "pay-for-delay" agreements may violate antitrust laws.

Jonathan Stratton, partner in the firm's Miami office and former Assistant U.S. Attorney for the Southern District of Florida, served as lead trial counsel for the firm's retailer plaintiffs. Miami partner Anna Neill has represented the retailer plaintiffs since the inception of the case and played a key role throughout the litigation.

Discussing the trial strategy behind the verdict, Jonathan told the DBR: "The lawyers who win complex cases aren't always the ones with the highest-paid experts or the thickest trial binders. They're the ones that make the jury care, and make the jury remember."

Anna noted that, "This verdict demonstrates that juries can understand these cases. Part of what defendants have relied on is the fact that the cases are complicated to muddy the water, and, frankly, confuse jurors and count on jurors not understanding the violation."

Other members of the trial team included Miami partner Scott Perwin, Austin partner Lauren Ravkind, Chicago counsel Dave Lesht, and Nashville associate Campbell Haynes. The verdict reflects the collective efforts of a dedicated team across the firm, including attorneys, paralegals, legal assistants, and professional staff whose contributions were instrumental throughout the litigation.
