SPERLING KENNY NACHWALTER SECURES TEMPORARY INJUNCTION CONTINUING BAYLOR DEFENSIVE LINEMAN TRAEVON MITCHELL’S ELIGIBILITY
September 16, 2026 – Sperling Kenny Nachwalter successfully secured a temporary injunction on behalf of Baylor University defensive lineman Traevon Mitchell, continuing his eligibility for the 2026-27 season following a temporary restraining order previously obtained by the firm.
Waco County Circuit Court Judge Alan Bennett granted the temporary injunction after finding that Traevon is likely to succeed on his claims that the NCAA breached the text of its Age-Based Rule and fairness commitments under the NCAA Manual by deeming him ineligible to play a fifth season.
“The NCAA Manual plainly does not exclude high school class of 2022 graduates who played only four seasons from playing a fifth season under the new Age-Based Rule. The NCAA Manual also contains clear commitments to those student-athletes that they'd be treated fairly when it comes to eligibility and seasons of competition. I'm grateful for the Court holding the NCAA to those commitments," said partner Blake Sercye, who led the representation.
The team also included Agustina Kloosterboer and Danna Abrahim. Charles M. Gearing of Weaver Johnston Nelson served as local counsel.
