Blake Sercye

Blake is a competition litigator whom executives and high-net-worth individuals trust to efficiently resolve their most consequential disputes. Drawing on his experience as a litigator, a Fortune 500 in-house counsel, and startup counsel and executive, he delivers impactful results in state and federal court and in arbitration and other alternative dispute resolution, tailoring his strategy to accomplish each client’s business and personal goals.

Blake is a trusted advisor to C-suite executives, corporate directors, business owners, and high-net-worth individuals, as well as senior leaders in private equity, commercial real estate, hospitality and retail, manufacturing, science and technology, and sports and entertainment. At the core of his practice is competition law. Blake counsels clients in disputes involving antitrust laws, public and private regulations, business partnerships, restrictive covenants, and the protection of customer relationships, talent, and confidential information. Clients benefit from Blake’s business-focused legal advice, honed through his experience as outside counsel and in-house counsel in litigation, white-collar, and transactional matters. Because he has sat in the client’s chair, Blake understands that the best outcome is one that resolves the dispute quickly, cost-effectively, and in a way that advances the client’s business objectives.

As an antitrust attorney, Blake represents companies that opt out of class actions to pursue their own antitrust claims, allowing them to control their litigation strategy, timing, and recovery rather than accept the outcome of a class settlement.

Blake also regularly represents companies in restrictive covenant disputes, where competition for customers, employees, and know-how turns into high-stakes litigation. He has both enforced and defended non-competition, non-solicitation, and confidentiality obligations for companies and their private equity sponsors in federal and state courts, including in the healthcare services and life sciences industries.

Blake also brings this approach to litigation in sports. He has represented numerous student-athletes in challenges to National Collegiate Athletic Association (NCAA) eligibility determinations, obtaining temporary restraining orders and preliminary and temporary injunctions throughout the country.

Blake previously served as Chief of Staff to the Chief Legal and Administrative Officer at a Fortune 500 materials science company, advising on corporate functions with a collective annual budget of approximately $400 million. Blake provided legal counsel regarding domestic and international disputes involving intellectual property, antitrust laws, and commercial agreements in the company’s most significant matters. He also helped lead efforts to reduce operational expenditures companywide by helping set cost reduction targets for corporate functions and aiding function leaders in developing plans to meet their reduction goals. After serving as Chief of Staff, Blake worked as the lead commercial counsel for one of the company’s business units with more than $800 million in annual revenue.
